What is the Immovable Property Commission of Northern Cyprus?

The Immovable Property Commission (IPC) is a legal body established under the Immovable Property Law. It provides remedies for property abandoned in Northern Cyprus, including restitution, compensation, or exchange.

Is the Immovable Property Commission legally recognised by the ECHR?

Yes. The European Court of Human Rights (ECHR) reviewed IPC procedures and concluded that it is a satisfactory, effective domestic remedy in line with the European Convention on Human Rights.

When was the Immovable Property Commission of Northern Cyprus established?

The TRNC Government passed the legislation in 2005, and the IPC officially started operating on 17 March 2006.

Who can apply to the Immovable Property Commission of Northern Cyprus?

Individuals, legal heirs, and companies may apply, provided the property was registered before 20 July 1974 and the applicant can prove legal ownership or inheritance.

Why do Greek Cypriots need to apply to the IPC first

In a 2010 ECHR ruling, it was established that the IPC is an effective local remedy. Greek Cypriot applicants must first submit claims to the IPC before approaching the ECHR.

What impact did the ECHR ruling have?

The 2010 judgment led to a significant increase in IPC applications, as many applicants consider it the most practical legal remedy for property claims

How does the IPC contribute to the Cyprus issue?

The IPC provides a fast, fair, and effective legal remedy, helping resolve property disputes and supporting the wider effort to achieve a settlement in Cyprus.

What documents are required for an IPC application?

Applicants must submit an affidavit and certified copies of the title deed, site plan, passport or ID, and any additional documents depending on whether the applicant is a company, legal heir, or represented by an advocate.

Is the IPC legally effective?

Yes. The ECHR recognised the IPC in 2010 as an effective local remedy.

Can legal heirs apply to the IPC?

Yes. Legal heirs may apply to the Immovable Property Commission of Northern Cyprus if the property was registered in the name of a deceased person before 20 July 1974.

What remedies does the IPC offer

The IPC may order:

  • Restitution (return of the property)
  • Exchange (alternative property)
  • Compensation
  • Additional compensation for loss of use and non-pecuniary damages where the property was a home
How is compensation calculated by the IPC?

Compensation is generally based on the market value of the property as of 20 July 1974, plus compensation for loss of use and, in some cases, damages for non-use of a home.

Do I need a lawyer to apply to the IPC?

Legal representation is not mandatory, but many applicants choose to instruct IPC specialists due to the complexity of proving ownership, valuation, and compliance with IPC procedures.

How long does an IPC application take?

The timeframe varies depending on the complexity of the claim, the evidence submitted, and whether the matter proceeds to settlement or disagreement.  our advisory team helps to streamline the application.

What is a Friendly Settlement?

Friendly Settlement is an offer issued after the IPC reaches a decision. If accepted, it is signed and implemented. If rejected, a notice of disagreement is issued, and further legal steps may follow.
